GENERAL CONDITIONS FOR CONTRACTING AND PROVIDING THE SERVICE
1. Purpose of the conditions
These conditions govern the contracting and provision of services offered by Jake Limousines.
By making a reservation, the customer declares that they have read, understood and accepted these conditions, as well as the specific details of the service contracted: vehicle, date, time, route, number of passengers, price, services included and possible extras.
2. Service reservation
To make a reservation, the customer must correctly provide the following information:
- Name and surname.
- Phone number.
- Date and time of service.
- Pick-up and destination address.
- Exact number of passengers.
- Hired vehicle.
- Additional services requested.
- Any other information necessary to organize the service.
Requesting information or availability does not imply that the vehicle is reserved.
The reservation will only be considered confirmed when Jake Limousines has received the corresponding payment and deposit and has sent the customer the service confirmation.
3. Payment methods
The down payment can be made using one of the following methods:
- Bizum: to the number provided by Jake Limousines.
- Immediate bank transfer: to the account number provided by Jake Limousines.
In both cases, the name and surname of the person making the reservation must be indicated as the concept.
The remaining amount must be paid as agreed before the start of the service. Unless otherwise agreed in writing, the remaining payment will be made to the driver before passengers board the vehicle.
If the remaining payment is not made, Jake Limousines may refuse to begin service.
4. Customer schedules, punctuality and delays
The service will begin counting from the time indicated in the reservation, even if passengers arrive late.
A maximum waiting time of 20 minutes is established. After this time, Jake Limousines may:
- Reduce the route to respect the scheduled completion time.
- Modify or remove any of the contracted stops.
- Charge for the additional time, if the driver and vehicle are available.
- Consider the service as not provided if the customer cannot be contacted.
Customer delays will not result in a free extension of the contracted hours.
If the customer provides an incorrect address, is not at the agreed point, or changes the pickup at the last minute, the time spent will be deducted from the service duration.
5. Route, stops and collection points
The route and stops must be agreed upon beforehand.
The driver may modify the itinerary when necessary due to:
- Traffic or delays.
- Streets closed.
- Works.
- Demonstrations or events.
- Traffic restrictions.
- Access or parking restrictions.
- Instructions from the police or any authority.
- Safety conditions.
The limousine will not be allowed access to ports, private areas, pedestrian streets, or restricted spaces without the corresponding authorization. In these cases, an accessible and secure meeting point will be established.
The time spent at stops requested by passengers is part of the contracted schedule.
6. Changes requested by the customer
Any changes to date, time, vehicle, route, direction or duration must be requested as far in advance as possible.
Changes will be subject to availability and may affect the final price.
Changes communicated directly to the driver during the service will only be accepted when they are possible, safe, and compatible with subsequent services.
7. Expansion of service
Extending the contracted hours will be subject to vehicle and driver availability.
The customer must accept the price of the extension before it is carried out. Requesting more time does not guarantee that it will be granted.
If another service is booked later, the limousine must end at the initially agreed time.
8. Cancellations by the customer
Cancellations must be communicated in writing via WhatsApp, email, or any other means that allows for a record to be kept.
If the customer cancels the service, the deposit paid will be held for future bookings with Jake Limousines.
The new date will be subject to availability. If the new service has a higher price, a different duration, a different route, or requires a different vehicle, the customer will have to pay the corresponding difference.
If the cancellation occurs within 24 hours of the service, on the same day, or when the driver and limousine have already started the journey, the customer will have to pay €50 as a cancellation fee.
This amount partially compensates for the costs of organization, driver availability, fuel, travel and loss of other possible services.
Paying these €50 does not eliminate the deposit saved for a future booking.
9. Passenger behavior
Passengers must maintain respectful behavior towards the driver, the vehicle, other road users and third parties.
It is forbidden to:
- Smoking inside the vehicle.
- Consuming or carrying illegal substances.
- Bringing in weapons or dangerous objects.
- Assaulting, threatening or seriously disrespecting the driver.
- To distract or hinder driving.
- Open the doors while driving.
- Sticking parts of the body out of windows or the roof.
- Tampering with electrical installations, screens, speakers or vehicle components without authorization.
- Throwing objects or liquids outside.
- Performing acts that may cause damage, discomfort, or dangerous situations.
The driver may stop or end the service if he believes there is a danger to driving, the vehicle, passengers or third parties.
10. Alcohol, drinks and minors
Participation by minors is permitted provided there is consent from their father, mother, legal guardian or responsible adult.
When the responsible adult is not traveling in the limousine, Jake Limousines may request that the authorization be submitted in writing beforehand.
Alcoholic beverages will not be provided or permitted to persons under 18 years of age.
The client responsible for the booking must control the behavior of the group and prevent excessive alcohol consumption.
Jake Limousines may deny access or terminate service when a person is in a state that could endanger safety, soil the vehicle, cause damage, or seriously disrupt the service.
11. Damage caused to the vehicle
The customer making the reservation will be responsible for any damage caused by him or by members of his group when such damage can be proven.
This includes, but is not limited to:
- Breakage of glasses, screens, lights or sound equipment.
- Damage to seats, upholstery, doors, ceilings or decorative elements.
- Burns.
- Permanent stains.
- Damage caused by blows, fights or reckless behavior.
- Improper handling of vehicle equipment.
- Loss or breakage of accessories belonging to the limousine.
Jake Limousines may claim the duly justified cost of cleaning, repair, replacement of parts and, where applicable, damages resulting from not being able to use the vehicle during its repair.
12. Group capacity and organization
The limousines have a maximum capacity of 8 passengers per transfer. However, Jake Limousines can accept bookings for groups of 10 to 12 people, arranging different transfers depending on the route, schedule, and availability.
The customer must communicate the exact number of passengers in advance.
If during the service the authorities order the group to be reduced or prevent the journey from continuing, Jake Limousines will try to find a solution to transfer the remaining passengers, provided that time and circumstances allow.
The solution may involve taking a different route or finding an alternative means of transport. If neither option is possible, the service will be terminated.
Jake Limousines does not guarantee the immediate availability of another vehicle or alternative means of transport.
13. Extraordinary cleaning
The price of the service includes a regular cleaning of the vehicle.
The cleaning required for the following is not considered ordinary cleaning:
- Vomiting.
- Major spills.
- Excessive amount of leftover food.
- Confetti, glitter, or similar materials.
- Stains on the upholstery.
- Excessive dirt.
- Waste that requires disinfection or professional cleaning.
When extraordinary cleaning is required, Jake Limousines may charge the customer the corresponding cost, providing photographs, invoices or any other available justification.
14. Vehicle decoration
Any decoration must be authorized in advance by Jake Limousines.
Glues, strong adhesive tapes, paint, staples, sharp objects, confetti, glitter or materials that may leave marks or damage the vehicle may not be used.
The customer will be responsible for removing any decorations provided and for any damage that this may cause.
Decorations offered directly by Jake Limousines, such as balloons or other extras, must be booked and paid for in advance.
15. Personal belongings, losses and shipments
Each passenger will be responsible for their belongings throughout the service.
Jake Limousines is not responsible for phones, bags, documents, money, clothing, gifts, or other items forgotten, lost, or damaged inside the vehicle.
If any item is found, it will be kept for a maximum of 15 days and the customer will be informed when it is possible to identify its owner.
The object may:
- Pick up in person at the agreed location.
- Deliver during another service, when possible.
- It can be sent by courier, provided that the customer pays all expenses in advance.
Once the item has been handed over to the transport company, Jake Limousines will not be responsible for delays, losses or damages attributable to said company, without prejudice to helping the customer to make the corresponding claim.
If the item has not been collected or claimed within 15 days, Jake Limousines will no longer be obligated to continue holding it.
16. Breakdowns, accidents and vehicle replacement
In the event of a breakdown, accident, or inability to provide the service with the reserved vehicle, Jake Limousines will attempt to offer one of the following solutions:
- Replace it with another available vehicle of similar characteristics.
- Modify the schedule by mutual agreement.
- Arrange an alternative means of transport.
- Return the proportional part corresponding to the service that could not be provided.
The replacement may be made with a limousine of another model or color when the originally contracted vehicle is not available.
If the offered replacement allows for the provision of an equivalent service, it will not be considered a total breach of contract.
17. Jake Limousine Delays
Jake Limousines will try to keep to the contracted schedule, but delays may occur due to traffic, breakdowns, accidents, police checkpoints, traffic restrictions or unforeseen circumstances.
If the vehicle arrives late due to a cause attributable to Jake Limousines, the contracted time will begin counting from the actual arrival, provided that it is compatible with subsequent services.
When it is not possible to recover the time, a proportionate solution will be offered, such as an extension on another occasion or a refund of the part of the service not performed.
18. Circumstances beyond the control of the company
Jake Limousines will not be liable for delays or modifications caused by situations beyond its reasonable control, such as:
- Severe retentions.
- Road accidents.
- Hazardous weather conditions.
- Traffic disruptions.
- Demonstrations.
- Police actions.
- Access restrictions.
- Unforeseen breakdowns.
- Emergency situations.
In these cases, we will try to adapt the service and find the most suitable alternative within the existing possibilities.
19. Data protection
The data provided by the customer will be used to manage the booking, organize the service, make the payment, issue invoices, answer queries and comply with the legal obligations of Limusinas Jake.
The data will not be used for advertising without the corresponding authorization.
Full information on data processing will be available in Jake Limousines' privacy policy.
